1. General rules and contact details

1.1. General rules.

For transactions between Rastma Ltd, Ziepju iela 5 k-1 – 35, Riga, LV-1004, Reg. No LV 40103604078 (hereinafter referred to as the “Seller”) and the Customer, only these General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) shall apply in the version in force at the time of placing the order in the online shop www.apaksvela.lv.

The Seller reserves the right to unilaterally amend and supplement the Terms of Use at any time. When the User shops at apaksvela.lv, the Terms of Use in the version valid at the time of ordering the goods shall apply, therefore the User must read the Terms of Use each time he/she shops.

  1. General Terms of Use of the Online Shop

2.1 When you place an order, we need your consent to process your data. The manner and form of processing of personal data is explained in the section “Privacy Policy”.

  1. Orders

3.1. Orders are placed via www.apaksvela.lv, so you do not need to register in our online shop to purchase goods;

3.2. The User is fully responsible for the accuracy of the data provided when making a purchase at www.apaksvela.lv. If the User has provided inaccurate or incorrect data when placing an order (purchase), apakvela.lv shall not be liable for the incorrectness of the data and the consequences thereof and shall be entitled to claim compensation for direct damages from the User;

3.3. During the order process, select the desired product, apply the size, colour, quantity and any other characteristics as required;

3.4. The online shop labels items so that you will get information about the size, colour, price and materials they are made of.

  1. How do I shop online?

4.1. You add the product you have selected from the product range to your online shopping basket by clicking on the “Add to basket” button;

4.2. All items placed in the shopping basket can be viewed by clicking on “Basket” in the top right section of the website. From here you can also delete items or change the number of items;

4.3. If you want to buy the items in your shopping basket, click on the “Checkout” button;

4.4. You do not have to register in our online shop to purchase goods. After registration, you have access to other options such as order summary and order history;

4.5. Payment method – online banking (payment by credit or debit card at the time of order);

4.6. By clicking the “Place Order” button, the Customer agrees to purchase the selected Product and undertakes to pay the price for the Product and delivery indicated. The customer has to choose one of Omniva’s parcel machines to which the selected goods will be delivered;

4.7. Upon receipt of your order, the Seller will send you an order confirmation by e-mail, which will repeat the details of your order;

4.8. After the order has been placed, another email will be sent to you with the delivery details.

4.9. The Seller may contact you by telephone (if you have provided a telephone number) or by email to clarify any issues that may be unclear about your order and delivery.

  1. Prices

5.1. All prices quoted in the online shop are in euros, including the statutory value added tax;

5.2. The price shown at the end of the order is the final price. The seller and the buyer are bound by this price. The price will not change thereafter, even if the Seller subsequently reduces or increases the price of the goods;

5.3.The website Apaksvela.lv  reserves the right to change the price of the goods or to set a special price for the goods. Goods are sold to the User at the prices prevailing at the time the order is placed.

  1. Availability of goods

6.1. The goods offered in the online shop are generally available. However, in rare exceptions, for example when several customers order certain products, it cannot be excluded that the products are no longer available. In this case, you will be notified immediately that the goods are not available. No contract is concluded for goods that are not available.

  1. Receipt of goods

The customer receives the goods at the chosen Omniva parcel office. The Customer is informed of the arrival of the goods at the parcel office by a text message containing the door code, the location of the parcel office, the return code and the storage period. The goods are stored in the parcel for 7 calendar days.  In the event that the User fails to collect the Goods within the time limit set out above, the User shall be liable for the costs of reshipment.

  1. Right of withdrawal

8.1. You have the right to unilaterally cancel the distance contract within 14 days from the date of receipt of the goods;

8.2. In order to exercise the right of withdrawal, the goods and the completed withdrawal form must be sent to the following Omniva outlet  – “Daugavpils T/C Ditton outlet Daugavpils”. The Customer shall bear the direct costs of returning the goods. If the deadline falls on a public holiday, the right of withdrawal is exercised up to and including the working day following the deadline.

A cancellation form will be attached to your purchase. You can also find an electronic withdrawal form at under “Returns”;

8.3. The returned goods must be in their original condition, without damage or signs of wear. The original labels and seals must be attached to the goods;

8.4. The money for the returned item will be refunded within 14 days of receipt of the “notice of cancellation”, provided that the returned item corresponds to its original appearance.

  1. Warranty

9.1. You can lodge a complaint about defects in the goods you have purchased under the Latvian Consumer Rights Protection Act. We will refund you for the faulty item;

9.2. The goods can be returned by the following Omniva parcel machine – “Valdlauči TOP parcel machine” (Atpūtas iela, Valdlauči, Ķekavas novads) or DPD Pickup parcel wardrobe – Paku Skapis TOP Valdlauči. The goods must be returned with a refusal form. When making the aforementioned  parcel post, please indicate the telephone number of the website apaksvela.lv +371 28384676 as the recipient’s contact information. You can now get a free return code(page) for orders placed in Latvia. For Omniva parcels, it is received in a text message, from DPD Pickup parcel lockers it is possible to receive a return card by writing to our e-mail. If you need a return code(page), please email veikals@apaksvela.lv.  When sending an Omniva parcel, the recipient’s contact details must include the phone number of the website apaksvela.lv +371 28384676. The goods must be returned with a cancellation form. The complaint will be considered within 14 days of receipt. The Seller will inform the Customer of its decision. If the decision is positive, the Seller will refund the value of the goods. If the complaint is not considered justified, an acknowledgement will be sent with an offer to collect the goods at the Omniva parcel office previously indicated by the Customer. In this case, the direct costs of returning the goods shall be borne by the Customer.

  1. Changes to these Rules

10.1 These Terms and Conditions have been drawn up in accordance with the laws of the Republic of Latvia.

Any disagreement arising in connection with these Terms shall be settled by negotiation. If no agreement can be reached, conflicts shall be settled in the courts of the Republic of Latvia in accordance with the procedures established by law. 

The Parties shall be discharged from their obligations under these Conditions if their performance is prevented by circumstances of force majeure;

10.2. The Seller reserves the right to unilaterally change and supplement the Terms at any time without notice by publishing them on www.apaksvela.lv in the section “Terms”. The Buyer shall be bound by the Terms in force at the time of ordering the goods and services. The Buyer is obliged to read the Terms and Conditions of www.apaksvela.lv before making any purchase.

  1. Responsibility

11.1. The Seller shall, in all cases of conflict, be exempt from any liability whatsoever if the loss arises from the Customer’s failure to read these Terms and Conditions, despite having been given the opportunity to do so, despite the Seller’s advice, when entering into the engagement.

The Seller shall not be liable for the Buyer’s decision to purchase the Goods based on images.

In the event of damages, the party at fault shall indemnify the other party only for direct damages.
